The Palestinian-led Boycott, Divestment, Sanctions movement (BDS) tries to put economic and political pressure on Israel, but many pro-Israel advocates say the campaign ultimately aims to undermine the country's security and financial stability. Now, new legislation in the United States Congress could make it illegal for businesses in the US to participate in BDS activity. According to the American Civil Liberties Union, a civil liberties organisation, the bipartisan Israel Anti-Boycott Act proposes to penalise support for boycotts of Israel or its businesses, with violations punishable by penalties of up to $1 million and 20 years in prison. In the US, at least 20 states have already adopted legislation targeting BDS involvement, or issued executive orders that prohibit state agencies fr...

Well, this can happen for many reasons. One of them is a tax inversion. But what are tax inversions, why are companies doing them and why should you care? Here’s the reason why. U.S. companies pay corporate tax rates of around 35 percent or more on their profits, while their foreign competitors pay much less in their countries. And if your company has locations or sells products in overseas, you get taxed on those profits in the foreign country and again when you bring that money back to the United States. This is called double taxation and your foreign competitors don’t have to pay it. This hurts your company’s ability to compete, grow and reinvest in new products and jobs. Hmmmm…now that doesn’t make sense. So, back to the tax inversion. If you’re a company based in the US and want to make sure you stay competitive with your foreign counterparts, and protect your company from foreign takeovers, what can you do? The current U.S. tax system allows you to buy a foreign company and use their headquarters as your own. That way you don’t have to pay the higher U.S. tax rates on foreign profits even though you still pay U.S. taxes on your profits in America. This move allows you to keep a lot more of your profits and invest in new factories, employees, and products. Look at it this way: Let’s say you lived in one city but commuted to another. If the rules were set-up so you were taxed by both cities on your income—essentially double taxation—you would probably consider moving to the city with the lower tax rates. It wouldn’t mean you were greedy, or disloyal—you would simply be working within the system of rules that exists. Now…that makes sense. So the next time you hear a politician complaining about American companies moving overseas, remember it was politicians who passed the laws that encourage companies to move away in the first place. If politicians would stop fighting with each other, lower corporate tax rates and end double taxation, U.S. companies could compete better and wouldn’t need to invert to protect jobs and their businesses.

In the past three years, 22 American companies have relocated outside U.S. borders, usually through mergers with or purchases of a foreign company. That move, known as a tax inversion, means corporations are no longer subject to American corporate taxes. Jeffrey Brown learns more about the strategy and its effect on the economy from Roberton Williams of the Tax Policy Center. Donald Trump helped stop Carrier from closing one of their Indianapolis plants and moving it to Mexico. Is it simply the greed of the CEO's that make them want to leave the US? Do you think taxes, regulations, liabilities, etc. could have something to do with it?

In the US, at least 20 states have already adopted legislation targeting BDS involvement, or issued executive orders that prohibit state agencies from contracting with businesses engaged in similar activity. Supporters of BDS contend that the movement is a successful expression of their freedom of speech as protected under the First Amendment to the US Constitution, which is why opponents have shifted to "legal warfare". BDS co-founder Omar Barghouti says this is because Israel and "its massive lobby" are "losing so many battles" in the court of public opinion. In October, the ACLU filed a federal lawsuit in the state of Kansas challenging anti-BDS bills, claiming that boycotts are protected under the First Amendment. But proponents of anti-BDS legislation say there's nothing "unconstitutional" about such measures, adding that they're in-line with an established US law that penalises corporations that "participate in boycott requests from foreign countries against US allies". Mark Levenson, chair of the New Jersey State Association of Jewish Federations, says BDS is "one of the greatest canards" of the 21st century, and that its supporters should be "condemned vigorously and publicly, roundly and soundly". "You can boycott Israel. That's your choice…But if you do, we will look to have [New Jersey] disinvest in you." So, what are the legal underpinnings of anti-BDS legislation, and what are the possible consequences for companies supporting BDS?
